1884 Succession of Martin Batte Lee, Dec'd., of Union Parish, Louisiana

NOTE 1: Martin B. Lee, was the son of John Cato Lee (26 Sept 1757 - 26 Sept 1832)
and Nancy Holland (1760 - 18 Oct 1838). John Cato Lee and wife, Nancy, died and
are buried in the Snow Hill Cemetery, Wilcox County, Alabama. Martin B. Lee and
his family moved from Wilcox County, AL to eastern Union Parish, Louisiana in about
1847. Martin B. Lee was born in Johnson County, North Carolina and he 1st married
Levincy Albritton ( 16 Mar 1800 - 12 Jun 1864) abt 1817 in North Carolina. They
moved to Wilcox County, Alabama along with his parents and then moved to Union
Parish, Louisiana. Martin B. Lee and his 1st wife Levincy had 12 children;
11 girls and 1 boy. Martin B. Lee married 2nd, after his wife's death, to Anna Nyegaard
(21 Aug 1825 - 15 Oct 1892). They married in Union Parish, Louisiana between 1864 - 1870.
He was a member of the Liberty Hill Baptist Church. Martin B. Lee and both of his wifes
are buried in the Liberty Hill Cemetery, Union Parish, Louisiana. Liberty Hill Cemetery
is also called the Taylor Cemetery. Martin B. Lee's family display bible is in the
possession of the transcriber, Hank Johns,located in North Little Rock, Arkansas as of
2006. A photograph of his Bible and a transcription of the data shown in his Bible are
shown on the Union Parish, LA website.

NOTE 2: This transcription was difficult because the photographic copies that were
obtained from the original Union Parish, LA. court records were poorly photo-copied.
Some pages did not copy the right side or the bottom of the page by 1/2 inch or so, thus
some words and complete sentences are missing. Also the quality of the photocopies is
poor (dim) and the hand writing is very faint at times. Every effort has been made to
transcribe this document properly; however I am sure there are errors in this transcription
... so BEWARE! This is my best attempt at this transcription as it took about 10 hours to
transcribe and proof read it.

the estate and that therefore an attorney for absent

Succession of Martin B. Lee Dec'd
To the Honorable the Judge of the 3rd Judicial District
Court in and for Union Parish, La.
The petition of John M. Lee Sr. Administra
tor of the Succession of M. B. Lee Dec'd with respect
shows that he has in hard belonging to said
Estate some personal property which ought to
be sold in order that it may be used to the best
advantage to heirs and creditiors as it will sell
for more now than at any time in the future.
He avers that there are about forty persons who
are interested as heirs to the Estate and many
of them are grand children and greatgrand
children and that all of the property will have
to be sold finally to effect a settlement of the
estate and to make a partition with all the heirs
but that owing to the fact that the deceased had
already made contracts for the cultivation of the
farm for the current year and had advanced
money and supplies to many hands on the farm
who are unable to pay for the same until they
make and gather a crop some of the property on
the farm will have to be set apart for the making
of the crop and cannot therefore be sold until
next fall. but some of the said property is not
needed for that purposes and will therefore bring
more money if sold now that at any future time.
There is a furplus of corn that may not be sale
able in the fall but it will bring a good price
now-there is on horse or mare pony and one
mule that are expensive to keep and are not
needed also a lot of bacon that is work more
now than it will be in the fall and a lot of hogs
and cattle that ought to be sold to prevent there
scattering and dying and being lost to the
estate. He avers that the estate owes a few debts
that ought to be paid such doctors bills-hands
on the place for unpaid ballances for making
the last years crops and a .......

He therefore prays for an order to sell such of the personal prop
erty belonging to said estate as ought to be sold now after legal
advertisement and that he be authorized to make said sale
for all sums up to five dollars for cash and the ballance
on a credit until the first day of November next with eight
per cent per annum interest on notes given with approved
personal security from day of sale and for general relief.

ministrator of the succession of M.B.Lee Dec'd be and
is hereby authorized to proceed to advertise and sell

erty named in his annexed petition at the late res-
idence of the deceased during the legal hours of
sale and that all the amounts of purchasers that
are five dollars and less be collected in cash on
the spot and all amounts above that sum be
sold on a credit until 1st day of Nov 1884 with
8% per annum interest from day of sale and the
purchasers are required to give good and sufficient
solvent security to be approved by the Administra-
tor. Thus done and signed at Chambers on
this April 15th 1884.
